SOCIAL MOVEMENTS AND JUDICIAL INSTITUTIONS IN THE COMBAT OF VIOLENCE AGAINST WOMEN: The case of the Santo André domestic violence annex
The present work aims to investigate the interactions between social movements and the
Judiciary to implement public policies to combat domestic violence against women,
contributing to the expansion of studies on the mobilization of the law by social
movements in Brazil. This research agenda has been explored in international studies
with greater intensity since the 1950s, but has only recently been incorporated into
Brazilian studies. The research seeks to understand how the interaction between
feminist social movements and judicial institutions took place that resulted in the
creation of the Domestic Violence Annex of Santo André/SP, analyzing the
participation of the actors involved in the process to implement this public policy in the
municipality. Therefore, this is a study that aims to look at the implementation of public policy at the local level. The theoretical framework of the research is based on the concept of legal mobilization by social movements and the object of study is the Domestic Violence Annex of Santo André/SP. The analysis was carried out through qualitative research, centered on the case study strategy, and for its completion interviews were carried out with two Judges from the Domestic Violence Annex and one from the Criminal Executions Court, four Feminist Militants who are members of social movements in the region and with a Councilwoman who works on the topic in the municipality of Santo André/SP. Documentary analysis was also carried out, through verification of documents, such as laws, ordinances, provisions, agreements and newspaper reports relevant to the topic discussed. In the analysis of these methodological procedures, it was possible to verify that there was a political action by feminist movements in the region, central to the implementation of the Domestic Violence Annex of Santo André, and that it took place through the articulation of social movements with local public authorities and aimed at effectiveness of a public policy.
