SUMMARY:

The core of this research lies in the analysis of the response of Brazil's National Migration Policy to the migratory flow of Venezuelans, which intensified from 2017 due to the growing political and economic crisis in Venezuela. This phenomenon, classified as one of the most prominent contemporary migration movements, posed substantial challenges regarding the normative framework provided by Brazilian immigration law. In particular, an investigation is necessary to assess the effectiveness of national legislation in addressing situations that transcend the traditional categories of forced and voluntary migrations, as well as the feasibility of incorporating the concept of "survival migration" proposed by Alexander Betts into this specific context. The research rests on a solid theoretical foundation in Migration, Refuge, and International Human Rights Law. This implies a critical analysis of traditional categorizations of migrations, the evolution of immigration law in Brazil, and the international norms and principles regulating the protection of the human rights of migrants and refugees. Our central hypothesis is that Brazil's National Migration Policy response to the influx of Venezuelans after 2017 has challenged traditional categories of migrations, generating the need for normative adjustments. We argue that the application of the "survival migration" concept to this specific scenario can provide a more appropriate framework for understanding and addressing the complex dynamics of this phenomenon. The research contributes to the debate on the inherent limitations of traditional categorizations of migrations and emphasizes the urgent need for more flexible concepts to encompass contemporary migratory phenomena. Furthermore, the analysis of Brazil's political and legal responses to this migration is essential to assess the country's commitment to human rights and its ability to adapt to crisis situations.Regarding the methodology, this research will adopt an interdisciplinary approach, combining literature review, documentary analysis of laws and regulations, and case studies. Data collection will involve a critical review of academic literature, in-depth analysis of legal documents such as laws and normative resolutions, as well as the evaluation of reports from international and national organizations. Additionally, individual interviews will be conducted with Venezuelan migrants in Brazil to understand their experiences and challenges in relation to the country's immigration laws and policies.
