Children in International Relations: contours of ambivalence in the international protection of refugee children

RESUMO:

This research will seek to identify, from the perspective of International Relations, the situation and condition of the refugee child in need of International Protection. Over the last 20 years, the issue of child migration has received a closer international look, so this work justifies the evolutionary analysis of the main conventions that govern the behaviors on how migrant children were perceived in the legal instruments, observing considerations about the role of the child as new actors in the international system. This work permeates the understanding of the intersectionalities that characterize the refugee child group, from the historical path of formation of the concept of what a child is and its needs, from the post-war period to recent studies that show the mixture of various categories within that group. In the first chapter, questioning what the protection offered in these international instruments would be, we will investigate how the refugee child has been perceived in the Convention Relating to the Status of Refugees (1951) and the 1967 Protocol, where the term refugee was defined internationally. they aligned the main rights to be guaranteed by the States. In the same chapter, compared to the analysis of the 1951 Convention and the 1967 Protocol, the Convention on the Rights of the Child (1989) will be investigated, its principles and protocols, aiming to point out the main concerns in favor of the rights and protection of children with brief background on the pre-Convention environment. The second chapter will analyze the UNHCR- United Nations High Commission for Refugees and the UN Committee on the Rights of the Child in the exercise of interstate mediation as international legal guardians of the protection of these refugee children; it also investigates the use of jurisprudence, with flexibility in the rules of procedure, in guiding the interpretation of articles by the States. The third chapter will jointly analyze the Global Compact on Refugees and the Global Compact on safe and orderly migration in the multilateral context, with a focus on refugee children. Of interest are the procedures that resulted in the current non-binding Pacts for States and future alignments on how migration and refugee will be dealt with. The use of a qualitative, hypothetical-deductive method will be the conductive axis of the bibliographic and documentary research, observing developments and possible advances in the protection of refugee children, regardless of the status, granted or not, contained in the main legal instruments mentioned, added to secondary sources interdisciplinary data from Capes thesis banks, Jstor, and reports from specific international agencies on children and refuge made available by UNHCR, IOM, UNICEF in the periods from 2015 to the end of 2020 under the COVID-19 pandemic.
