RESUMO:

The present research starts from the Marxist concept of Primitive Accumulation to demonstrate the logic in which the processes of demarcation of indigenous lands in Brazil are inserted. It appears that the executive branch does not fulfill its constitutional duty in relation to indigenous rights. Thus, many demarcation processes seek resolutions in the judiciary. Based on this fact, this study presents the relationship between State and Law in the capitalist perspective. Considering the limits of capital expansion and the growing attempt to expropriate indigenous communities from their lands, the study also addresses the association between the way of life of the original peoples and the limits of nature through reflection between the concepts of Anthropocene and Capitalocene. The main objective of the research is how the flexibilization of the Law contributes to the reproduction of capitalist logic from the demarcation processes. The main authors that make up the theoretical framework are Karl Marx, Rosa Luxemburg, Alysson Mascaro, Boaventura de Sousa Santos, Paul Crutzen, Bruno Latour, Michael Löwy and Ailton Krenak. In addition to the theory presented, there will be an empirical analysis of data on demarcation processes of indigenous lands between the years 2008 to 2018, and in particular the analysis of the demarcation process of the smallest indigenous land in the country, located in the city of São Paulo: Tekoa Pyau, Jaraguá / SP. Finally, the research will point out suggestions demonstrating how the reproduction of aspects of the original peoples' way of life can contribute to the creation of a less economically unequal and less exploited society in the global south.
