RESUMO:

Brazilian urbanization was not accompanied by the elaboration and implementation of governmental public policies capable of meeting the demand for housing for the working class as urban centers grew. In this context, the poor population ends up being expelled from areas of interest of the capital and relegated to spaces of little or no commercial relevance, constituting settlements in environmentally protected areas, distant peripheries and abandoned buildings in city centers. The social organization demanding legal guarantee to land tenure and implantation of basic infrastructure in the occupied areas resulted in the creation of forms of flexibility of the urban parameters rigidly stipulated in the Federal Law of urban land parceling, Law nº 6.766/79, for the settlement of the population in the places of occupation respecting the typicality of the occupation, as well as allowing the popular management of the actions of the government with works of urban improvement: the ZEIS. Currently, the need to elaborate the instrument of the Land Regularization Plan for urbanization and land regularization actions in ZEIS is a reality in the legislation of many municipalities that have advanced in the implementation of public housing policy of social interest and in the land regularization policy. It turns out that very little has been written specifically about the instrument and its elaboration and application remain being carried out without a theoretical deepening capable of supporting the choice for a minimum content, the necessary stages of popular participation in its elaboration and the scope of its determinations. This theoretical gap ends up reflecting on the possibility of procedures for drawing up plans permeated by uncertainties in relation to their conformation. The present study, therefore, aims to contribute to the knowledge of the instrument and reinforce its use in the search for the realization of the rights to housing and the city.
