SUMMARY:

Islamic feminism, developed in the Middle East and North Africa in the 1990s, constructed an activist discourse that questioned the patriarchal model of family present in laws or personal status codes in different countries in the form of family laws (or personal status codes) through an independent interpretation (ijtihad) Islamic doctrine (Quran, Shari'a and fiqh), while reconciling Islam with the demands of gender equality.  The exponents of this movement, such as Ziba Mir-Hosseini, Asma Barlas, Amina Wadud and Fatima Mernissi, argued that the "traditional and patriarchal" interpretations of religious sources should be questioned based on jurisprudence (fiqh), especially those dealing with marriage, divorce and custody of children. For them, the central obstacle to gender equality would be in the way in which jurists understood and legislated about the relationship between the notion of male authority (expressed in concepts such as qiwamah and wilaya) and   that of obedience by women in the family sphere.  The new gender activist discourse began to push for reforms in family laws based on classical jurisprudence and articulated differently according to the demands, reality and historical experiences of each movement and/or country.  This research seeks to investigate how the principles developed by the exponents of Islamic feminism have provided the argument of women's social movements in their search for rights and reforms in family laws.  To this end, the performance of social movements of Muslim women will be analyzed at the national level (the case of Morocco) and at the international level (through the analysis of documents and actions developed by Musawah, the global movement of Muslim women for equality) from the frames (frameworks): women's rights, human rights and agency.
