Between locks and uniforms: transformations on São Paulo’s Penitentiary Security Agents’ career into criminal police in PCC hegemony scenario

The purpose of this research is to understand the changes on Penitentiary Agents’ career in São Paulo, determined by conditions of the Brazilian prison system, especially regarding PCC’s actions, and by demands of their own category, which culminated in the transformation of them into criminal police. To this end, we investigated the prisons’ reality and how they function in Brazil, the whole environment where penitentiary agents work and criminal factions were established, considering questions about purposes of penalties, the supposed resocialization function in prison, the conflicts around the idea of humanization of prisons in SP and the history and dynamics of PCC's activities. We also aim to understand the work developed by these agents - according to the official rules that regulate their profession; to map the political movements around the approvement of the Constitutional Amendment Proposal about Criminal Police in Congress and conduct a tangent contextualization of changes related to the penitentiary agent profession, with an emphasis on the state of São Paulo and the related normative, social and circumstantial specificities. In order to understand the demands for changes in the profession, we interviewed 10 criminal police officers who have worked in closed, semi-open and open regimes, in 13 municipalities in the state of São Paulo. We noticed among these workers’ perceptions that the relations in the prison environment, in a scenario of factionalization, accentuate the tensions already demarcated in the prisons context and that the PCC hegemony is a phenomenon that transforms the agents' role, while the faction existence also becomes a justification for the category's claims, directly interfering with the character of these workers main function, associated with social reintegration. In the end, we seek to analyze the arguments and justifications that were at the base of the political discourses that supported the Criminal Police creation in Congress. In methodological terms, we chose to select the senators' speech, producing legislative document analysis and surveying the justifications for its approval. We identified four main arguments: the agents’ professionalization; the gun license; the resumption of prisons control by the government; the answer for the prison system “crisis”. The speeches defending the creation of a new police in Brazil, supported by a punitive logic and grounded in common sense, are unfolded in the central idea of fighting factions, and situated in a process of global transformations of ideas about crime control and punishment, marked by the historical and structural asymmetries and inequalities that cross Brazilian society.
