Migratory labels in debate: reflections on the scenery of asylum applications in Brazil (2011-2020)

RESUMO:

Over the last ten years, Brazil has recorded an unprecedented increase in the number of requests for recognition of refugee status, when the cumulative total went from 3,556 in 2010 to 317,963 in 2020. The process of eligibility of these requests is made by the Refugee Law N. 9,474/1997 and managed by the National Committee for Refugees (CONARE). When analyzing the data of these requests, it is noted that, with the exception of the recent migratory movement of Venezuelans, the majority of asylum seekers are denied by the committee. Research focused on the specificities of the asylum seeker population in Brazil is particularly scarce, so this study aims to answer the following question: why are so many people who apply for asylum in Brazil currently denied? We work with the hypothesis that Brazilian bureaucratic and governmental institutions, such as CONARE, have a restrictive interpretation of the refugee law, especially with regard to the criterion of the gross and generalized violation of human rights (item III of Article 1) and that they justify the high rate of denials stating that most cases, in fact, are "economic migrantion", that is, movimento of people who would have migrated looking for better living conditions instead of suffering from individual persecution. As a theoretical reference, we will rely on Zetter's studies (2007) on migratory "labels" and the "labeling" of migrants in order to understand how this category is managed by the Brazilian State from its domestic and foreign policy interests and also by the migrants themselves who seek Brazil. As methodology, we will use literature review and semi-structured interviews with representatives of CONARE, civil society institutions and with asylum seekers.
