International Trafficking of women: building an international regime with a focus on human rights? - Case studies Brazil/Spain

RESUMO:

This research aims at verifying if we are facing a construction process of an international regime to confront human trafficking, especially women, with an emphasis on human rights. It stems from the acknowledgment of the existence of a regime to combat human trafficking, disposed mainly by the United Nations Convention against Transnational Organized Crime and the Palermo Protocol (2000), which unfolds from a security rationale and the international criminalization of transnational organized crime. This regime gives the State a central role, leaving the protection to the victims in the background. The research focuses on the international trafficking of women for the purpose of sexual exploitation, building the underlying elements that characterize and specialize this kind of trafficking for this specific profile.  In this sense, it is noticeable that this regime excludes a regime of protection to women. Hence, the core of the research focuses on the possible construction of international protection of the women who are victims of trafficking from a perspective based on Human Rights, bringing the victims to the central debate in the policies related to human trafficking. The approach privileges organizations in the civilian society, especially those located in Brazil and Spain, for occupying distinct spaces within the power arrangement of the internal institutions of each country, and that have been guiding the protection of victims in the realm of the States. The research has a qualitative, documentary and bibliographic nature, with exploratory research (interviews). The interviews were recorded and transcribed, giving voice especially to the women and organizations from the civilian society that were interviewed. The analysis demands the perception of idiosyncrasies of the main actors to understand fears, perceptions and motives for action. The research describes the processes behind the development of internal public policies to confront human trafficking in Brazil and Spain, from the incorporation of international norms in Palermo, including the way public policies created internally are described, to the developed governance and institutions, analyzing if these have allowed the creation of a regime with an emphasis on human rights, aiming at and prioritizing the protection and attention to the women who are victims. There is the intention to identify elements that are relevant to the construction of a regime based on human rights, raising reflections for an intervention within this perspective. In the final considerations, it is assessed that the powerplay among the actors, in the international and internal domains of the state, also considering the interests and agenda of these actors, have been allowing for advancements in the construction of a mindset towards the need to protect the victims and, in the internal realm, public policies that force and condition the states to protect and assist the victims can be verified. On the other hand, there is still much to be developed and, especially, a lot to be done so as to effectively bring the victim of human trafficking into the center of the international and national actions to confront human trafficking, especially women.
